Learn about the coverage conditions, terms, responsibilities, and recommendations that apply to Arkos Brasil products.
This Warranty Statement is provided by Arkos Brasil to the consumer identified on the sales invoice, and its purpose is to ensure support for the purchased product, under the terms and limits described herein.
This is a contractual warranty, complementary to the statutory warranty provided for in the Consumer Defense Code (Law No. 8,078/1990). It extends consumer protection and does not exclude, replace, or reduce the rights already guaranteed by law, including the statutory deadlines for claiming defects (30 days for non-durable goods and 90 days for durable goods - Art. 26 of the CDC).
The contractual warranty period is counted from the issue date of the sales invoice. In the case of a latent defect, the statutory claim period is counted from the moment the defect becomes evident (Art. 26, §3, of the CDC).

See below for the conditions applicable to the warranty of products sold by Arkos Brasil.
The warranty covers manufacturing defects and flaws in the product, understood as:
Validity condition: coverage assumes that the installation, maintenance, and use of the product have complied with the installation manual and technical data sheet provided by Arkos.
As a rule, the defect will be remedied within 30 days from the approval of the report (Art. 18, §1, of the CDC). When replacement depends on manufacturing and/or importing the product, this period may be extended, by express agreement between the parties, to up to 150 days from the approval of the report, never exceeding the statutory limit of 180 days (Art. 18, §2, of the CDC).
Whenever replacement cannot be completed within 30 days, the consumer may choose, at their convenience and under Art. 18, §1, of the CDC, between: (a) waiting for the replacement within the extended period; (b) receiving a similar available product; or (c) obtaining a refund of the amount paid, adjusted for inflation, or a proportional price reduction.
The warranty does not apply when the problem does not result from a manufacturing defect, notably in the following cases:
Damage that does not result from the product is not covered, such as:
When Arkos handles the delivery, it is responsible for the product’s integrity until it is actually delivered to the consumer. From that point on, damage caused by improper handling, transportation, or storage by the consumer or by third parties hired by them is not covered by the warranty, as it does not constitute a manufacturing defect (e.g., a product received intact and later scratched during handling).
Delivery inspection: we recommend that the consumer inspect the product upon receipt and report any visible damage within 7 days. This period is intended for reporting visible transport/handling damage and does not affect the statutory warranty for defects (30 or 90 days, as applicable - Art. 26 of the CDC) or the contractual warranty for manufacturing defects.
Disclaimer: no provision of this Statement excludes the liability of Arkos and the manufacturer for damages actually caused by a product defect (Arts. 12, 13, and 25 of the CDC).
To preserve the product’s warranty and durability, we recommend:
This Statement is governed by the Consumer Defense Code. In case of doubt regarding the interpretation of any clause, the interpretation most favorable to the consumer shall prevail (Art. 47 of the CDC). The rights provided herein are in addition to, and never override, the consumer’s statutory rights.
The photos, videos, and data provided by the consumer to claim the warranty will be processed exclusively for the analysis and handling of the warranty request, in accordance with Law No. 13,709/2018 (LGPD).
