Social Media Cookies: These are set by a number of social media services that we add to our platforms to enable You to share our content with your friends and acquaintances. These cookies are able to track Your browsing on other websites/platforms and create a profile about Your interests, and may affect the content and posts You see on other websites/platforms You visit.
For example: The Instagram cookie enables You to post our products and services on your personal account, as well as share our content in your stories and/or with your friends and acquaintances on the network.

Advertising Cookies – These are inserted in our platforms so that third parties such as media vehicles can target advertising according to your preferences, based on your browsing activities. There is no collection of personal information, only information from your browser and internet device(s). If you do not allow these cookies, you will receive less targeted advertising.
For example: The Facebook cookie uses a unique number generated for each visitor on our platforms, which will be stored for 3 (three) months for the purposes of analysis and sending advertising. As we are always striving to improve our products and services, this Cookie Policy may be updated to reflect improvements we have made, as well as to reflect any regulatory changes.

For this reason, the date of the last update will always appear at the beginning of this Policy, and in the event of a relevant update, we will provide appropriate transparency regarding the changed content on our platforms, and we strongly recommend that you read this Policy periodically.

Shipping and Returns Policy

Will only be accepted:

  • Within 30 calendar days from the day of delivery/receipt of the product.
  • The product must be complete with original packaging, instruction manuals, warranty certificates and accessories.
  • The product must be accompanied by the Invoice.

The following will not be accepted

  • Products that have been used (except for cases of technical or manufacturing defect or vice, verified after use).
  • Products purchased on balance, custom-made and/or personalized.
  • According to Article 49 of the Consumer Defense Code, you can exchange or give up your purchase within seven calendar days from the date you receive the product. You can get back the amount you paid within ten working days or exchange it for another product that is in stock. However, this exchange or return can only be made if the product is in its original packaging, with no signs of use and keeping the original seal unbroken.
  • An important tip: choose the colors and measurements of your products correctly. We have a qualified sales team that can help you before the purchase. We do not exchange products that have been used.
  • Before returning or exchanging a product we need to know what happened to your product, you need to tell us through one of our channels the reason why you are returning or giving up the product you purchased.
  • Send an email to contato@arkosbrasil.com.br with your order number, stating your problem. Our team is available during business hours to help you solve any order problems.
  • Once we have made contact with you, we will assist you in returning the product in the correct manner. When the product arrives at Arkos, we will analyze it and if everything is according to our company’s norms and standards, your problem will be solved.
  • The time of the exchange will depend on where you live, remembering that we depend on the delivery time of the Post Office or Carrier.
  • If the chosen product is not available for exchange, you have a few options: choose another product, opt for a shopping voucher, or cancel the purchase. If the chosen product has a higher value than your first product, the difference can be paid by bank deposit into an account informed by our customer service team.
  • With the voucher, you will receive a code to use for your next purchase on the Arkos site. If you do not want to make the exchange, you can cancel your purchase right after finishing the return process.

The return of amounts paid will only be held after return of the product to Arkos Brazil.

Payments with credit card: The deadlines for reversal of the amounts depend exclusively on the credit card company and may occur within 2 (two) invoices later.

Payments with bank billet or made in cash (cash) in stores: The return will be made through bank deposit within 10 (ten) working days from receipt of the product and the necessary information. The CPF of the account holder for the return must be the same as the CPF of the purchase holder.

Payment Policies

This site is owned, maintained, and operated by Arkos Brasil, a coatings company, with address at Rua Geraldo Flausino Gomes, 42, Cidade Monções, CEP 04475-060, São Paulo – SP, registered in the CNPJ/MF under No. 20.300.907/0001-83.

Should the User require any information, clarification or assistance regarding this Payment Policy, Arkos Brasil makes available the customer service to receive all communications that the User wishes to make. The service of attention to the client operates by means of the communication channels listed below: (a) By telephones (11) 4543 – 6741 (phone) (b) (11) 97119 – 6692 (Whatsapp), from Monday to Friday from 8h to 17h; except holidays, always accompanied by the contact information of the consumer, so that we can finalize the service.

In all cases, the User will receive, by the same communication channel, a confirmation of receipt of your demand, which will be treated and answered within a maximum period of 7 (seven) days. Moreover, Arkos Brazil makes available on this site a section of FAQ (Frequently Asked Questions), as well as its other policies: Exchange and Return Policy, Product Delivery Policy, Privacy and Security Policy and, finally, the Terms and Conditions of Use of this Site. All these documents can be consulted online.

3.1 Credit Card

3.1.1 The Customer may use 1 (one) credit card issued in Brazil in his name, either as holder or dependent, with the following cards: Visa®, Mastercard®, Elo, Hiper, Diners, Celebre! and American Express®.

3.1.2. The deadline for acceptance of the order is up to 72 hours from the date of approval of the payment by the banking institution.

3.2 Bank payment slip

3.2.1 The term for a Boleto Bancário is 2 (two) business days and its payment must be in cash, in a single installment and in the total amount of the Purchase made.

3.2.2 The confirmation of receipt of the amount will occur within 2 (two) business days after the due date of the boleto.

3.2.3 Should the payment of the boleto be made by check, the deadline for confirmation of receipt will be up to five (5) business days, after the check has cleared.

3.2.4 The order will proceed to the flow of shipping after confirmation of receipt of payment by Arkos Brasil.

3.2.5 The order will be automatically canceled in case of non-payment or payment with different value from that in the bank slip.

3.3 Payment in installments

3.3.1 In the online store we can pay in up to 6 installments without interest.

3.3.2 The installment plan is subject to change and will be indicated on the product.

4.1. Arkos Brasil makes available a descriptive page for each product, with information regarding the characteristics, composition, availability in stock, payment terms and total price at sight and in installments.

4.2. After choosing the product the Client will be directed to the cart and may view: the product, the quantity chosen, the value, as well as calculate shipping. After viewing the data will be necessary to identify the delivery information and choose the means of payment.

4.3 The Arkos Brazil, immediately, will send an e-mail to the Client informing the number of purchase order, product, quantity, price, shipping amount, means of payment and the estimated time or the delivery schedule.

4.4 After the finalization of the Purchase, for security measure, Arkos Brazil will not accept changes of means of payment, product, product quantity, place of delivery, registration data and date or shift of delivery.

4.5 To change the means of payment in Purchase made through bank billet, simply do not make your payment that the billet will be automatically canceled. Then, simply redo the Order and choose the payment method of your choice from those available on the Site.

4.6 During the purchasing process, an estimated delivery time will be informed, considering: the product, its quantity, the available stock, and the distance between our distribution centers and the delivery address informed by the Customer.

4.7. The delivery period will be counted from the date of approval of the payment by the banking institutions and may vary according to the means and method of payment chosen.

5.1. The Order may be cancelled if there is any inconsistency related to any data informed by the Customer.

5.2 In purchases made by credit card, as a security measure, an accredited third party may contact the Customer requesting data as necessary to confirm the purchase.

Privacy Policy

Arkos Brasil is committed to always providing the best materials and services to our clients. We are therefore very serious about complying with the laws that protect your privacy, and this Privacy Policy describes how your personal data is collected, used, shared and stored. If after reading this Policy you still have questions, please feel free to contact us using the contact information listed at the end of this Policy.

This Policy applies to our websites, e-commerce platforms, applications, wi-fi networks, and all the ways we may treat the personal data we have about you, including data collected in offline media, such as our showroom in São Paulo.

In order to uncomplicate its reading, we present some useful definitions for its interpretation:

(i) “Legal Bases” are the legal hypotheses that authorize Arkos Brasil to treat Personal Data, namely: consent, compliance with legal or regulatory obligation, by the public administration, for the performance of studies by research bodies, for the execution of contracts or preliminary procedures, for the regular exercise of rights, for the protection of life or physical incolumity, for the protection of health, for credit protection and when necessary to meet the legitimate interests of the controller. Any and all processing of Personal Data performed by Leroy Merlin can only be considered valid if it is founded on a Legal Basis, as will be explained in section 3 of this Policy.

(ii) “Personal Data” is any information that can identify a natural person: CPF, name, telephone number, computer IP, cookies, purchase history, e-mail, etc.

(iii) “Sensitive Personal Data” is that which has an intimate nature or is capable of generating discrimination to an individual, namely: racial/ethnic origin; political party and religious organization affiliation; data referring to religion; data referring to health or life; biometrics or genetic data.

(iv) “Anonymized Personal Data” is that which does not identify a natural person, and may be used, for example, for statistical purposes.

(v) “Digital Platforms” or “Platforms” are the sites and applications owned by Arkos Brasil.

(vi) “Providers” are the sites and applications of third parties, such as social networks and search platforms, which may offer our products and services.

(vii) “Treatment” or “Handling” are the uses that Arkos Brasil makes of the Personal Data, including, for example, the following activities: collection, recording, storage, organization, consultation, use, disclosure, sharing, transmission, classification, reproduction, processing and evaluation. These terms shall not be capitalized in this Policy.

(viii) “You” or “Data Subject” is the person with whom we are most concerned and respected, and also to whom the Personal Data relates.

The types of Personal Data and the way in which arkos Brasil collects it depends on how You engage with us, so we inform below what Personal Data we collect and why we do it:

Registration Data: information voluntarily provided by the holders, such as name, surname, e-mail, bank details, address, phone number, company/organization, photo, function or position, date of birth, subjects of interest, resume (in the event of submission of profile to apply for one of our vacancies), when registering on our platforms and/or when using our products, services and stores or requesting clarification.

Rationale: This information is necessary for us to provide you with our services and products, and you can view the full list on the Privacy Portal where you can request a copy and conduct other activities regarding the use of the information.

Please note that such information may also be obtained from public sources where applicable and will be used to ensure you have access to the products and services provided by Arkos Brasil and to respond to your requests, comments and queries.

Sensitive Personal Data: the collection of such data is made only in the hypotheses legally permitted.

Justification: Examples of Sensitive Personal Data that we may obtain or maintain include: – Race or ethnic origin when properly disclosed by the data subject. – Biometric data of private individuals, beneficial owners of corporate entities or applicants to vacancies offered by Arkos Brasil.

Data arising from the relationship of the holder with Arkos Brasil: we collect contact data that enable the establishment or maintenance of the relationship of the holder with Arkos Brasil.

Justification: Through the contact data is possible to carry out the sending of communications about products, services and news in general about Arkos Brasil, as well as proceed with interactions related to surveys conducted with consumers, such as satisfaction surveys and analysis of users who submit evaluations on specific aspects of their relations with Arkos Brasil.

Electronic device and user interaction log data: such as IP address, mobile device ID, geolocation and other information related to the user interaction with our platforms such as date and time of access, time spent on pages, areas visited, features and functionalities used, click logs and browsing history.

To collect such data, we use cookies and other similar automated browsing data collection and monitoring technologies on our Platforms to provide our online services in the best manner available to You. Rationale: The information collected will allow Arkos Brasil to undertake initiatives for the continuous improvement of your experience with us such as:

(i) Promote an analysis of your relationship with us to better understand your consumer profile;

(ii) Increase the performance of our platforms and customize product and service offerings to You;

(iii) Define, through geolocation data provided under Your consent, the prices charged in Your region and the products available for purchase

Underage Data: Our platforms and services/products are directed to an adult audience and we do not intentionally collect data from children and adolescents.

Rationale: Limit the use of Arkos Brasil platforms, services and products to those over 18 (eighteen) years, and if any details about minors are received on our platforms and / or stores, our employees and also systems have been instructed to proceed with the blocking and automatic deletion of such data.

Voice data, biometrics and closed circuit television (CCTV): Showroom, facilities and other institutional channels may collect images and recordings of the owners that provide physical and behavioral characteristics.

Rationale: The information collected will allow Arkos Brasil to carry out initiatives to ensure the security and welfare of the holders, such as:

Promote the surveillance service in our showroom and premises, being that the data obtained via CCTV are automatically overwritten after 30 days.

Assist in the fight against fraud, so the biometric data collected are passed on directly to our anti-fraud business partners and/or financial institutions (such as Banco Cetelem) and are not stored by Leroy Merlin.

Detect the origin and veracity of the information provided in our Arkos Brasil Service Channel (CALM), and the voice data obtained will be stored for 2 years, for the purpose of legal protection and availability in case of eventual actions by the owners and/or authorities.

Conduct an analysis of the relationships and activities promoted by the holders in our stores and platforms in order to better understand their consumer profiles, and the data obtained are anonymized and used in statistical studies.

Health data: our Showroom and other premises can measure the temperature of the entrants in attention to the social isolation imposed by COVID-19.

Justification: Attend the state and municipal legislations that deal with COVID-19 and the due mandatory precautions. Arkos Brasil does not store this data, which are automatically deleted after the permitted temperature verification.

Data collected by Providers: Our products and services may be offered by Providers. In such cases, the information You have spontaneously agreed to provide will be collected by the Provider and passed on to Arkos Brasil.

IT IS WORTH NOTING THAT ARKOS BRASIL RECEIVES THE INFORMATION AS THE PRIVACY POLICIES OF THE PROVIDER AND IS NOT RESPONSIBLE FOR THE PRACTICES OF TREATMENT AND STORAGE OF INFORMATION EVENTUALLY COLLECTED BY THEM.

Thus, it is recommended that You consult the respective privacy policies of the Provider’s websites and applications to be properly informed about the use of Your personal information and, in case You do not agree, check the existence of resources made available by the Provider to control Your privacy.

Rationale: The information collected by Provider and passed to Arkos Brasil will be used to ensure that You enjoy our products and services, as per the examples below:

(i) possibility of connecting to Arkos Brasil sites and applications by logging into existing accounts with the Provider, such as Facebook and Google registration accounts (activity in which there will be cross-publishing and cross-service authentication features).

(ii) making purchases with our marketplace partners (Providers), since if there is no cross data with us, it will not be possible to complete the order and proceed with your purchase.

(iii) customizing and enhancing your experience with us through the use and analysis of the User Interaction Information that is collected by the Providers and passed to Arkos Brasil.

Social Network Browsing Data: We may collect, through a monitoring and marketing management program, social network browsing data such as comments and ratings made by users on Arkos Brasil.

Arkos Brasil may justify processing Personal Data on the following Legal Basis for operating our business and providing our services:

Consent: We may use the Personal Data (including sensitive) that You have authorized us to process voluntarily and through your free, informed and unambiguous consent on our platforms and channels.

Performance of Contract or Preliminary Proceedings: We may process Personal Data to perform our contractual obligations or enter into contracts.

Legitimate Interests: We may rely on legitimate interests, provided that the processing is assessed in advance for fair, reasonable and balanced processing. Among the hypotheses of data processing based on legitimate interests, we have the following situations:

  • To enable the data subjects to continuously use our products and services.
  • To provide personalized content through direct marketing, which we believe users will welcome.
  • To investigate complaints and conduct audits.
  • To develop studies, projects, training and the like.
  • To prospect clients and business partners.
  • To inform the registered users of our platforms about events, campaigns, facilities and benefits.
  • For transactional communications, which include information on orders, purchases, tracking, etc.

Legal and regulatory obligations and the regular exercise of rights: We may process Personal Data to comply with our legal and regulatory obligations or mandates, as well as in legal actions or administrative or arbitration proceedings to which we are a party.

In general, we use the Personal Data collected for purposes related to the offer and use of our products and services, as well as for communicating with holders about news and features of our platforms and stores.

In this context, the processing of Personal Data is necessary to:

  • Comply with the contractual obligations assumed, ensuring operability, visibility and continuity in the offer and delivery of products and services on our platforms, marketplace and/or physical stores.
  • Define and adjust the format of our content, including to deliver customized and more assertive material.
  • Customize the user experience by enhancing the performance, functionality and efficiency of Arkos Brasil’s online presence.
  • Manage the Loyalty Program of Arkos Brazil in order to enable registration of interested parties and the provision of features, communications and benefits to them.
  • Identify and authenticate users properly, to enable attendance to requests and questions regarding our products and services.
  • Analyze traffic trends, as well as track data about the use of our platforms, measuring the effectiveness of our marketing activities.
  • Elaborate user profiles and performed transactions, to personalize the products, services, and benefits offered, as well as the communication with the holders.
  • Perform research and various statistical surveys for the analysis of indicators and business strategy.
  • Filter and direct job opportunities according to the profile of the candidate, when they are made online submissions of curricula to apply for a position in Arkos Brazil;
  • Increase the security of our clients and combat fraud in our services;
    Comply with legal or regulatory obligations and/or exercise rights in legal, administrative or arbitration proceedings.
  • Perform interaction through posts, comments, participation in courses and workshops in the platforms “Leroy Community” and “Future of Living”.
  • Enable the purchase of products whose sale is controlled, such as spray paints, chainsaws and solvents.

In addition to these situations, we may use data in an anonymized form (that is, in a way that does not lead to the direct or indirect identification of an individual), in order to improve and personalize the products and services offered.

In addition, we may use automated systems/processes and automated decision making (such as profiling) in certain processes, such as in the following example: if there is a change in our loyalty program regulations which affects a specific audience, such as blocking features for users who have not used our products and services for over a year, we may search our databases using automated criteria to compile a list of such users.

You may request a review of decisions made solely based on automated systems/processes, as well as request information regarding the criteria and procedures used, subject to Arkos Brasil trade and industry secrets. For the exercise of this right, please access the Privacy Portal.

Arkos Brasil operates in partnership with a number of other companies to offer its products and services. As such, we may share your Personal Data with these Arkos Brasil partner companies, always seeking to preserve your privacy to the fullest extent possible and, where possible, in an anonymized form. Here are examples of situations where we will share Personal Data and their respective purposes:

Our Partners and Suppliers: We have a number of partners and suppliers that we need to engage to operate our services and products, and some of them may handle some of the Personal Data we collect, such as technology and data hosting service providers, market research and data consulting companies, product carriers, and, payment processing, among others. We carefully evaluate our vendors and enter into contractual obligations with them regarding information security and protection of Personal Data, with the goal of minimizing risks to Data Subjects.

Marketplace Partners: When you shop on our e-commerce platform, it is possible that some products are marketed by merchant partners with whom we have a commercial relationship (Providers). In such cases, in order to process your orders, some of your Personal Data may be shared with the partners involved in your purchase for the purpose of fulfilling your orders.

Fraud Prevention Partners: To enable fraud detection, we may share some Personal Data indicated by our partners, which may even lead to the contracting of specific anti-fraud services.

Public Authorities or Official Bodies: Where we are under a legal or regulatory obligation that expressly requires us to provide Personal Information to a government agency or organization, we are required to do so. In addition, if a judge or an authority with legal or regulatory competence requires Arkos Brasil to share certain Personal Data in order, for example, to conduct an investigation, we are also required to share it. If Arkos Brasil believes that a particular order is abusive or excessive, we will always defend the privacy of the Personal Data Holders.

Although Arkos Brasil is based in Brazil and the products and services are intended for persons located in Brazil, and therefore Brazilian laws relating to the protection of Personal Data apply, the Personal Data that we collect may be transferred to countries located in the European Union, such as France and Spain.

Such transfers occur because of relationships with certain Arkos Brasil suppliers and business partners that may be located in these locations. In addition, our business partners may also send Personal Data received for the performance of the contracted services to sub-processors and/or third party operators with servers hosted in other countries.

However, such transfers only involve organizations that demonstrate that they are in compliance or in advanced process of compliance with applicable laws, and maintain a level of compliance similar to or even stricter than that provided for under applicable Brazilian law.

The Personal Data is yours, and Brazilian law guarantees You a number of rights related to it. We are committed to enforcing these rights and in this section we will explain how You can exercise these rights with Arkos Brazil:

1. Confirmation of Processing and Access to Data

Arkos Brazil allows you to confirm whether we hold Personal Data about You, as well as allows You to access such Personal Data. You can obtain this information directly on our Platforms, by entering your profile area, or request it through the Privacy Portal and, if found to exist data, we will send a file for your use, via e-mail informed by You or via physical letter, addressed free of charge to the address informed in your request.

2. Correction or Updating of Data

Leroy Merlin allows you to request corrections to your Personal Data if you identify any outdated or incorrect information. To do this, log on to our platforms, go to My Account and change your registration data in your profile area or request a change of data via the Privacy Portal.

3. Anonymization, Blocking or Deletion of Data

You may request (a) the anonymization of your Personal Data, so that they can no longer be linked to You and therefore cease to be Personal Data; (b) the blocking of your Personal Data, temporarily suspending the possibility for us to treat them for certain purposes; and (c) the deletion of your Personal Data, in which case we shall delete your Personal Data, without possibility of reversal.

At this first moment, Arkos Brasil will not perform the anonymization and/or blocking of the Personal Data, but for You not to have these rights injured, Arkos Brasil then offers the option to delete such data, thereby confirming their non-use, if so requested by You in the Privacy Portal.

It is worth noting, however, that it is possible that, even after your request, some Personal Data remain stored in our base (s), as a way to comply with legal obligations or for the protection of the activities of Arkos Brazil. In such cases we will maintain our commitment to confidentiality and protection of the data that need to be kept.

If you, even after requesting about the treatment of your personal data to Arkos Brasil, still believe that your request has not been properly processed, it will be possible to complain to the ANPD. Whenever the holder exercises his rights, Arkos Brasil may request some additional information for the purpose of proving his identity, seeking to prevent fraud. Also, some requests may not be answered immediately, but Arkos Brasil undertakes to respond to all requests within a maximum period of thirty (30) working days and always in accordance with applicable law.

You can only have a single User Account, since the account is linked exclusively to your CPF at the time of registration. ARKOS may, at its sole discretion, block, restrict, disable or impede your access to the Platform if it considers your conduct inappropriate.

Our promotional campaigns offer certain products at prices lower than usual, with discounts applied or other conditions.

These promotions will not be cumulative and may be limited, as advertised through all media.

Our Platform may contain links to third party websites. We do not research or ensure the processing of your data by these sites, and you are solely responsible for visiting these pages, so we recommend that you read the Terms and Conditions and Privacy Policies governing each site you visit.

Arkos Brasil does not guarantee that the Platform, its content, its features and tools:

  • Will be available at all times.
  • Are fit for a particular purpose and therefore may not meet your expectations; and be free from defects, errors or failures and we are not liable for any indirect, incidental, consequential, punitive, lost profits or other damages.

You are solely responsible for your use of the Platform, its content, tools and features. We shall not be liable for damages and/or monetary losses related to any claim, lawsuit or other proceeding taken in relation to the use of the Platform, its content, features and/or tools.

In this regard, Arkos Brasil’s liability is excluded in the following circumstances, among others:

(i) Damages and losses that the user may experience by the unavailability or partial operation of the Platform and/or of all or some of its services, information, content, functionality and/or tools, as well as by the inaccuracy or inaccuracy of any of these elements;

(ii) Damages and losses that the user may experience on internet sites accessible by links included on the Platform;

(iii) Damages and losses the user may experience as a result of the use of the Platform not in compliance with this Agreement (Terms and Conditions of Use) and/or the policies;

(iv) Damages and losses the user may experience as a result of the use of the Platform not in compliance with the law, customs or public order;

(v) Damages and losses that the user may experience as a result of failures in the Platform, including those resulting from system, server or network connection failures, or malicious interactions such as viruses, software that may damage the equipment or access information on the user’s equipment;

(vi) Damages and losses that the user may experience as a result of distortions that the images of the products may present, emphasizing the merely illustrative nature of such images; among others;

(vii) Damages and prejudices that the user may experience as a result of the inadequate and/or inappropriate use of his/her data by Partner Stores and/or service providers (for which reason it is again recommended that the privacy policy of these third parties be read)

ARKOS liability for defects in the products offered for sale on the Platform is detailed in the exchange and returns policy.

This Agreement (Terms and Conditions of Use) will remain valid until a new version is posted on our Platform.

We reserve the right to modify and/or amend this Agreement, as well as our Platform, Policies and Documents at any time as necessary to reflect our business practices as well as any regulatory updates. For this reason, the date of the latest update will always appear at the beginning of this Agreement, and we will provide appropriate transparency regarding the changed content on our Platform in the event of a material update, and we strongly recommend that you periodically review this Agreement.

If any provision or condition contained in this Agreement is declared unenforceable, in whole or in part, such unenforceability shall not affect the other provisions of this Agreement.

This Agreement will be governed by the Brazilian laws, being stipulated the Central Forum of the County of São Paulo, SP, Brazil, as the only competent jurisdiction to settle any question or controversy arising from or resulting from this Agreement and/or the use of the Platform.
